Member Terms and Conditions

These Member Terms and Conditions were last updated on November 11, 2009.

By submitting video, image, written, audio or other Content to Expo, or by participating in any active promotion or program of Expo, you (referred to as "Member") acknowledge that you have read, understood, and agree to be bound by these Member Submission Terms and Conditions. These terms and conditions are in addition to the Upload Agreement you may execute upon submitting Content to Expo, and Expo's General Terms and Conditions which are incorporated by reference herein. If there is any conflict between the Member Terms and Conditions and the Upload Agreement, the Upload Agreement will govern. If there is any conflict between the Member Terms and Conditions and Expo's General Terms and Conditions, the Member Terms and Conditions will govern. Expo reserves the right to modify, terminate or change the Member Terms and Conditions and any program governed by these Terms and Conditions in its entirety, at any time, and for any reason without notice.

Creating and Maintaining Member Accounts

A "Member Account" is established by you during the registration process and includes creation of a password. The Member Account includes all data captured and maintained by Expo regarding the Member including but not limited to the Member's personal information, Site participation history, Rewards tracking, and other participation with Expo. You acknowledge that any information entered by you into your Member Account, or information collected by Expo from your activity as a Member, is given willingly by you. Upon creating a Member Account, you agree to provide Expo with a current email address and to update such information immediately upon any changes. You may not use a false email address, impersonate any person or entity, or otherwise falsify any information provided by you in your Member Account. You may maintain only one Member Account and creation of more than one Member Account may be construed by Expo as fraudulent behavior. You are responsible for maintaining the confidentiality of your password and Member Account, and are fully responsible for all activities that occur under the Member Account.

Content Indemnification

You are solely responsible for the Content of any materials you post or submit to the Site (regardless of form or media, the "Content"). You represent and warrant that you own or otherwise control all of the rights to the Content that you post and submit, that the Content is accurate, that use of the Content you supply does not violate the General Terms & Conditions or these Terms and will not cause injury to any person or entity. Further you represent and warrant that you will indemnify Expo for all claims resulting from Content you supply.

Citizenship and Minimum Age Requirements

Content may only be submitted by U.S. legal Residents. All Members submitting Content must be at least 18 years of age. Parents/legal guardians submitting Content may include their children at their own discretion and hereby agree to hold Expo harmless from any claims resulting from such inclusion. Members must be 21 years or older to submit Content featuring an alcoholic product.

Content Authenticity, Unbiased Perspective and Truthfulness

All Content must reflect the Member's true, accurate and honest opinions and beliefs. Members expressing an opinion about a product must be a bona fide user of the product. The positive or negative opinion expressed by the Member in a product review will have no bearing in the acceptance of Content under any program. To eliminate potential bias, Members cannot be affiliated with a company that sells, distributes, or is otherwise affiliated with the product or service featured in the Content. The Member cannot be affiliated with any product or service that competes with the product or service featured in the Content. Other than by Expo, Members cannot be compensated or otherwise personally enriched, directly or indirectly, for submitting Content. Content must be created solely and expressly for Expo and be your original creation.

Community Standards

Content cannot feature products deemed unsuitable for a broad consumer audience or products for which there lacks a broad consumer interest ("Unqualified Products") as determined solely in the discretion of Expo. Such Unqualified Products may include, but are not limited to: Prescription medicine, firearms or tobacco. Content cannot feature copyright infringing materials. Expo will not disqualify Content containing copyrighted materials where the use of such materials constitutes fair use under the U.S. Copyright Laws, such as for commentary and criticism of that specific product. For more information about fair use, click here. Content must not contain any profanity, offensive language, nudity or otherwise objectionable material as determined solely in the discretion of Expo. (See more standards under "User Content and Community Guidelines" in General Terms & Conditions.) Content must not contain anything considered unsafe, dangerous or violent, as determined within Expo's sole discretion.

Receiving and Publishing of Content by Expo

Expo is not responsible for the failed submission of Content to Expo for any reason, including without limitation technical failure by Expo (e.g., browser time-out, server failure, etc.). Expo is not responsible for technical failure of any kind to a Member or anyone else's computer due to participation in an Expo promotion or program.

By accepting or allowing you to submit Content to the Site, Expo is not obligated to publish the Content and reserves the right not to use, display or make available to the public the Content for any reason in Expo's sole discretion. Expo reserves the right to remove from the Site any previously published Content and/or category of Content for any reason and at any time in its sole discretion. If Expo accepts Content, it may take up to four weeks for the Content to be published on the Site. Rights and Usage of User Content by Expo and other Third-Parties

It is understood by you that the intention of the Content is to use your authentic opinion to inform a broad range of consumers whether on expotv.com, or on any other media off our website. Any Content submitted to Expo may be used for any purpose by Expo, its agencies or any third party approved by Expo (including product manufacturers or retailers) and may be posted on any media for public viewing, comments and rating. For purposes of clarity, Content (or any portions or derivative works) submitted by users may be used on third party websites including ecommerce, video sharing, social network and manufacturer sites in print, online, television, radio or any other media. Submission of Content constitutes permission for Expo, its agencies or any third party approved by Expo (including product manufacturers or retailers) to use the Member's name and likeness, in whole or in part, in connection or not in connection with the Content, and in accordance with the Privacy Policy, for promotional or any other purpose in any media without additional compensation. In addition, within the guidelines of our Privacy Policy, personally identifiable information may also be transmitted to the third parties for their public and private use as it pertains to Content used by such third parties.

These Terms are in addition to the Upload Agreement you may execute upon submitting Content to Expo which is incorporated herein by reference, whereby Members assign and transfer all rights, title, and interest in the Content (including, without limitation, all copyrights, ideas, know-how and techniques in the Content) to Expo as further indicated in that Agreement. If there is any conflict between these Terms and the Upload Agreement, the Upload Agreement will govern.

Cancellation or Revocation of Member Accounts

Any Member who uploads Content without complying with these Member Terms & Conditions and/or the General Terms & Conditions, or who submits Content under fraudulent or harmful circumstances, may be disqualified from this and any future promotion or program, forfeit any accumulated or due benefits or points, as well as be pursued for other legal remedies. A determination to cancel, revoke, modify or otherwise amend a Member Account will be made by Expo in its sole discretion.

I. General Guidelines for Content Submitted Under Promotions

All Content submitted for qualification under Expo incentive programs (such programs together called "Promotions", including receipt of free product, "points" under Expo Rewards, sweepstakes entries, other incentives) must conform to the following guidelines unless otherwise stated in the specific Promotion. Qualification decisions are made in Expo's sole discretion, are binding and final. Reasons for disqualification may or may not be communicated to Member.

  • Member face must be clearly identifiable if the Promotion submission Content is in image or video format. If such Content includes one or more persons other than the Member, the Member must obtain appropriate consent from such person(s) authorizing the Member to submit the Content in accordance with the Upload Agreement, including but not limited to, Expo's (or any third party authorized by Expo) use of the Content for commercial purposes.
  • Content must include a reasonable level of consumer information or product demonstration and/or be related to the assignment or topic, and/or meet quality standards as determined by Expo.
  • All Content must be in the English language and video or audio Content must be of a satisfactory quality (i.e., brightness, focus, volume) as determined solely in the discretion of Expo. Unless otherwise noted, video submissions must be a minimum of approximately 1 minute in length and conform to technical specifications as set forth in the upload process.
  • All Content submitted to a Promotion as a product review must provide the product name and model number within the video portion of the submission. For Content submitted as a product review, Expo will not reject Content due to a negative opinion expressed in the Content.
  • Unless otherwise noted, Members may not submit Content for any Promotion for which the Member has already submitted Content. Members may submit only one product review for a single product (i.e. SKU or model number).

In addition, the following rules apply to all Promotions unless otherwise stated within the specific Promotion rules:

  • Unless otherwise indicated by Expo, all Promotions or programs are subject to cancellation or change at any time in Expo's sole discretion. All previous offers and Promotions regarding Promotion terms and conditions will no longer be valid. Points or other payment amounts are subject to change at any time. Additional restrictions may apply.
  • Determination of Content qualification for a Promotion is within the sole discretion of Expo and all decisions are final.
  • Expo reserves the right to disqualify, refuse to compensate, not accept or not publish any Content for any reason, in its sole discretion. Expo may or may not communicate such reasons for disqualification to the contributing Member.
  • Employees of Expo (and members of their immediate family and/or those living in the same household) are not eligible for any Expo promotions or programs.
  • Any Member who uploads Content without complying with these Terms of Service or who submits Content under fraudulent or harmful circumstances may be disqualified from this and any future promotion or program, forfeit any accumulated benefits, as well as be pursued for other legal remedies.
  • All federal, state and local taxes for any reward or incentive received by a Member, if any, are the sole responsibility of the Member. Member understands that Expo will issue Form 1099s to Members who redeem points for merchandise in the Expo Store, or are provided any other compensation, which total to an amount of $600 or greater in value in any given year. Expo hereby specifically declines to offer any tax advice to Members. Members should consult with their tax or legal advisor on the appropriate reporting and treatment of any incentives offered by Expo.
  • Promotions defined as "monthly" begin on the first day of the current month at 12:00am EST and end on the last day of the current month at 11:59pm EST (the "Program Period"). Expo reserves the right in its sole discretion to offer (or not offer) a similar program in any subsequent month.
  • Any Promotion program is void to Members where prohibited by law. Expo does not accept mail-in submissions. Subsmissions by mail will not be returned.

II. Specific Promotion Programs: Tryology, Refer-A-Friend, Surveys & Other Site Activities

In addition to any other terms for these programs as set forth on the Site, the following terms also apply:

Tryology Program Terms

Expo reserves the right, in its sole discretion, to determine who shall be eligible to apply for inclusion as well as to ultimately take part in any of the Tryology Programs offered from time-to-time on the Site. Expo may, at its discretion, remove a Member from a Tryology Program (or any other program) at any time for any reason. If you are removed you will be contacted via e-mail.

When you sign up for a specific Tryology Program, you may be asked to agree to special or additional terms governing your participation of the specific program ("Supplemental Terms"). In such cases, you will be asked to expressly consent to the Supplemental Terms, for example, by checking a box or clicking on a button marked "I agree" and/or by signing and mailing back a hard copy of the Supplemental Terms. If any of the Supplemental Terms are in conflict with the terms of this Agreement, the Supplemental Terms will govern.

Any product, service or coupon related thereto offered by Expo is not intended for resale In certain cases, resale may even be illegal. Any violation (as determined solely by Expo) of this provision by a Member may result in removal from the program, or permanent revocation of the Member's Account.

From time to time, Tryology products may become damaged during shipping. Please notify customer service if this happens. Due to the limited availability of products in these programs, Expo cannot guarantee replacements.

Specific conditions for participation in individual Tryology offers will be communicated at time of invitation by Expo directly to Member. Invitation is non-transferable and only valid for the Member selected and invited directly by Expo. The Member must follow enrollment instructions as specified in each invitation in order to participate. If at any time you determine that you are unable to submit the requested Content for a Tryology offer that you have accepted, (e.g. the Product you receive was damaged in the mail, you do not have access to a camera over the specified time period, you are affiliated with a company that sells or distributes the Product) you must contact Expo immediately at contactus@expotv.com.

Refer-A-Friend Program Terms

Qualifications for the Refer-A-Friend Program ("Referral Program") are contingent on referring a new Member to Expo who confirms their account. There are additional incentives if the referred Member subsequently submits a video that gets published to the Site. Members can earn sweepstakes entries for referring new members to Expo in any given month. To be eligible to participate in the Referral Program, you must have an active Member Account and must have uploaded a video to Expo that has been published to the Site. At least one of your videos must have already been published on the Site before any referred Members confirms their Member Account.

Additionally, the newly referred Member must have never previously registered a Member Account under any user name. Members may not have more than one Member Account and therefore cannot refer themselves. Members may not refer direct family members. The referred Member must be an individual with whom you have a pre-existing relationship. You may not obtain names for referrals from group email addresses, third party bulk mailing lists, customer lists, or other similar sources. The newly referred Member cannot create more than one Expo member account. Referrals cannot be applied retroactively. Sweepstakes entries are only available for new Members who click on your customer Refer-A-Friend link from the referral email that you send to him or her or from posting in somewhere on the internet. See official rules for details.

Surveys, Sweepstakes and Other Site Activities

Surveys and sweepstakes sponsored by Expo, merchants and/or strategic partners may be made available on the Site for Members. Expo uses the data collected from these activities to assist it and its merchants, advertisers, strategic partners to provide better services, programs, promotions and products. Any information provided in such activities shall be subject to our Privacy Policy. Expo may or may not award points for participation in any of these Site activities.

Members can earn points by answering questions that are asked by Site visitors about a product you have reviewed. Expo will credit your Member Account with 25 points the first time you answer a specific question. You will not earn additional points for any subsequent answers to this question. For an answer to be eligible to earn points, the answer must be of a sufficient quality as determined by Expo in its sole discretion. Members can earn points for answering no more than 20 questions each month.

III. Rewards Program Terms

Through the Expo Rewards Program ("Rewards Program"), Members can be awarded varying number of "points" for participating in designated Promotions and redeem them at the Expo Store online. By participating in a Promotion, you further agree that:

  • Rewards Program points are credited to a Member's Member Account upon the successful completion of the Promotion. Points expire twelve 12 months after being placed into the account. Please allow up to four (4) weeks from the end of the month in which the submission occurred for awards to be credited to Member Accounts.
  • Members are responsible for verifying the accuracy of the point balance in their Rewards Program account. Any discrepancies, including unauthorized award claims or erroneous point awards must be reported to Expo Contact Us within 30 days from the date the change is made to the account, or will not be reviewed.
  • Points are for the sole redemption of the submitting Member and may not be transferred between Members. Points may not be sold, bartered or purchased.
  • Rewards Program Terms are subject to change or program cancellation at any time without notice, including cancellation of Member's points awarded but not yet redeemed. Expo may, among other things, (i) withdraw, limit, modify or cancel any award; (ii) change program benefits, conditions of participation, rules for awards, points required for a product redemption, retention or forfeiting of points, or the rules of use without notice; and (iii) correct or otherwise modify points balances within a Member Account at any time.
  • All questions or disputes regarding eligibility for the program, eligibility of points for accrual, conversion of points or redemptions of rewards will be resolved by Expo at its sole discretion.
  • Maintaining the integrity of the Site's incentive programs is critical for the enjoyment and benefit of all Members. Therefore, any behaviors which are intended or in fact actually manipulate, alter or cause the failure of any portion of the Site or any Member's Member Account will cause immediate termination of any contributing Member's Member Account and immediate forfeiture of accumulated points. Such behavior includes but is not limited to: a) the misrepresentation of information furnished to Expo or its affiliates, b) using the Site to pursue or further any harmful or illegal activities as determined in the discretion of Expo, c) evidence of electronic or non-electronic tampering with any portion of the Site or d) introducing a computer virus, bugs, unauthorized interventions, or technical difficulties or failures compromising, corrupting or affecting the administration, integrity, security, fairness, or proper conduct of any Site service or Program, e) other fraud or abuse as defined by Expo in its sole discretion.

Point Redemption/Merchandise Orders

Points required for redeeming a product may change at any time. All orders are subject to product availability. You will be notified if the item you have ordered is not available and when it will become available. We reserve the right to substitute items of equal or greater value. We will ship the model pictured, or the most current comparable model available (Expo is not responsible for typographical errors). Depending on the manufacturer some items may be on back order. We will make every effort to inform you of the expected delivery date in these cases. Multiple items in one order may be ship separately.

Merchandise will be delivered to your door within 3-4 weeks of placing the order, with the exception of truck-shipped items indicated by notes in the product description. Allow 6-8 weeks for delivery of truck-shipped items unless otherwise specified. Deliveries are made Monday-Friday during standard business hours to addresses in the 48 contiguous United States. Merchandise cannot be delivered to P.O., A.P.O. or F.P.O boxes. Expo is not responsible for lost or stolen products, gift certificates or other merchandise. Expo is not responsible for incomplete, inactive or otherwise incorrect information submitted by the Member during the redemption process.

Merchandise Return and Cancellation Policy

Unless otherwise specified, users may not cancel an order after the redemption is made. Please contact Customer Service with any delivery issues by using the Customer Service Form located in the Expo Store, under "Store Questions".

Merchandise may not be returned or exchanged unless proven to be damaged or defective. If an item is received damaged or defective, Customer Service must be contacted within 48 of receiving the item. Damaged or defective items must be returned within 30 days of delivery. If a damaged or defective item needs to be returned, Customer Service must issue a return authorization number for the package prior to the return. Return instructions and policy are as follows: Products must be in their original packaging and include batteries, cables, remote controls, etc. Expo is not responsible for returns or exchanges in any case beyond these stated dates.

E-certificate Terms of Use

All E-certificate orders will be emailed directly to the email address specified in your Member Account at the time your order is placed. E-certificates will be emailed to the specified address within 3-5 business days of order placement. E-certificate orders may not be canceled, returned or exchanged. Expo is not responsible for incomplete or inactive or otherwise incorrect email addresses as submitted by a Member.
